Terms and Conditions

Please read these terms and conditions carefully before using our platform. By accessing or using our service, you agree to be bound by these terms. If you disagree with any part of these terms, you must not use our service.

Article 1 – Purpose and role of the platform

1.1 Nature of the service

The platform MyAssistantPro connects recruiters ("Clients") with independent virtual assistants ("Assistants") through a technical intermediation service.

1.2 Intermediary role

MyAssistantPro acts exclusively as a technical intermediary between Users. The platform facilitates connections but does not intervene in the execution of the service contract, which directly binds the Client and the Assistant.

1.3 Independence of Assistants

Assistants act as independent service providers. They are not bound to MyAssistantPro by any employment contract, mandate, or commercial representation agreement.

Article 2 – Registration and access to the service

2.1 Account creation

Access to the platform requires creating a User account. Registration is free and reserved for adult individuals or legal entities duly represented.

2.2 Login credentials

Each User is responsible for the confidentiality of their credentials and commits not to share them with third parties. Any connection or action performed via a User's account is deemed to be performed by them.

2.3 Access suspension

MyAssistantPro reserves the right to suspend or terminate an account in case of violation of these Terms of Service or fraudulent use of the service.

Article 3 – Limitation of liability

3.1 Platform liability

The liability of MyAssistantPro is strictly limited to providing technical connection tools. MyAssistantPro cannot be held liable for:

  • Non-performance, poor performance, or late performance of services by Assistants;
  • The quality, compliance, or adequacy of services to the Client's needs;
  • Direct or indirect damages resulting from relationships between Client and Assistant;
  • The truthfulness of information provided by Users on their profiles.

3.2 Liability cap

In any event, the liability of MyAssistantPro is limited to the amount of commissions actually received on the transaction concerned, up to a maximum of €100 per incident.

3.3 Force majeure

MyAssistantPro cannot be held liable for any failure to fulfill its obligations resulting from force majeure events or fortuitous circumstances.

Article 4 – Payment process and validation

4.1 Payment methods

Payment is made after delivery of the service, through secure payment services integrated into the platform.

4.2 Service validation

The Client manually validates the service and proceeds with the corresponding payment.

In the absence of payment, the service is considered lost and MyAssistantPro assumes no responsibility for the failure to pay. No automatic validation or payment triggering is performed by the platform.

4.3 Platform commission

MyAssistantPro takes a commission of 12% including VAT on each settled transaction. This commission is directly deducted from the amount paid to the Assistant.

Article 5 – Fees and commissions

5.1 Pricing structure

Platform commission: 12% including VAT of the service amount.

Payment fees are integrated into this commission and covered by MyAssistantPro.

5.2 Fee distribution

Client

Pays only the service amount.

Assistant

Receives the service amount, minus the commission taken by the platform.

5.3 Calculation example

For a service of €100 with 12% commission:

  • Amount paid by the Client: 100 €
  • Platform commission (12%): 12 €
  • Amount paid to the Assistant: 88 €

Article 6 – Dispute management

6.1 Non-intervention principle

MyAssistantPro does not intervene in resolving commercial disputes between Client and Assistant.

6.2 Facilitation tools

In case of disagreement, the platform provides a communication space to facilitate dialogue between the parties.

6.3 External escalation

Failing an amicable agreement within 15 days, each party may refer the matter to competent courts or resort to mediation. MyAssistantPro is not a party to the dispute.

6.4 Reporting

MyAssistantPro reserves the right to suspend or delete any account in case of fraudulent, abusive behavior or behavior contrary to these terms.

Article 7 – User obligations

7.1 Truthfulness of information

Each User guarantees the accuracy and sincerity of the information provided on their profile and commits to keeping it up to date.

7.2 Compliance with legislation

Users commit to respecting applicable legislation, particularly regarding tax, social, and professional matters.

7.3 Proper use

It is forbidden to use the platform for illegal, fraudulent purposes or purposes that infringe on the rights of third parties.

Article 8 – Data protection

8.1 Data controller

MyAssistantPro processes personal data in accordance with GDPR and its Privacy Policy.

8.2 Purposes

Data is processed only for the needs of the connection service and transaction management.

8.3 User rights

Each User has the right of access, rectification, erasure, and portability of their data.

Article 9 – Intellectual property

9.1 Platform content

All elements of the platform (interface, logos, texts, etc.) are protected by the intellectual property rights of MyAssistantPro.

9.2 User content

Users retain their rights to the content they publish and grant MyAssistantPro a usage license limited to the needs of the service.

Article 10 – Security and proper functioning

10.1 Technical security

Users commit not to disrupt the proper functioning of the platform (hacking attempts, code injection, etc.).

10.2 Security flaw reporting

Any User discovering a security flaw commits to immediately inform MyAssistantPro without taking advantage of it.

Article 11 – Modification and termination

11.1 Modification of Terms

MyAssistantPro reserves the right to modify these terms with 30 days notice by email.

11.2 Termination

Each party may terminate their account at any time. MyAssistantPro may suspend an account in case of violation of these terms.

Article 12 – General provisions

12.1 Applicable law

These terms are subject to French law.

12.2 Jurisdiction

In case of dispute, the courts of Paris have exclusive jurisdiction.

12.3 Severability

If a clause is declared null and void, the other provisions remain applicable.
